Jones filed this § 1983 action alleging that the defendants violated his civil rights in the enforcement of a Marietta city ordinance. Jones alleged that he had been prosecuted under the ordinance but had been discharged from the conviction by the Superior Court of Cobb County, Georgia. That court had ruled, however, that the city could retain the fine originally assessed against Jones.
