This cause is here on error to the municipal court of the city of Cleveland, wherein the Union Savings & Loan Company commenced suit against the defendants, George Kupetz and Anna Kupetz, predicating its claim upon a written assumption by the defendants of a certain note and mortgage held by the plaintiff, under which assump tion it was sought to recover a judgment against the defendants for a deficiency remaining ’after the exhaustion of the mortgage.
