OPINION

By DOYLE, J:

James E. Taylor is a lieutenant in the fire department of the City of Cleveland. The litigation in the Common Pleas Court involved the right of the lieutenant to recover a money judgment against the City of Cleveland upon a claim for overtime pay for work performed in his capacity as such fireman.

The action is one of six or seven hundred like actions against the city by individual members of the department, and was selected by counsel as a test case.
