Plaintiff Frank Odierno brings this action pursuant to sections 205(g) and 1631(c)(3) of the Social Security Act (the “Act”) as amended, 42 U.S.C. §§ 405(g), 1383(c)(3), for judicial review of a final determination by the Secretary of Health and Human Services (the “Secretary” of “HHS”) denying his application for supplemental security income based on disability (“SSI”) (hereinafter “disability benefits”).
