LATIMER, Justice.

This is an action to recover damages for personal injuries and property damage arising out of a collision between an automobile driven by plaintiff, and a train operated by defendant.

The accident happened on the 21st day of October, 1943, at about 10 :00 o’clock in the morning. The weather was cloudy but at the time of the collision visibility was good. Mrs. Drummond, the plaintiff, left her home at 1753 Center Avenue, Ogden, Utah, to proceed to the main shopping district of town.
