Respondent Herbert S. Moncier (“Respondent”) has been suspended as a member of the bar of the Eastern District of Tennessee for a period of three to five years pursuant to E.D.TN. LR 83.7 (Court File No. 69). In re Moncier, 550 F.Supp.2d 768 (E.D.Tenn.2008). Respondent has appealed the order of suspension to the United States Court of Appeals for the Sixth Circuit.
