Plaintiff in error, Frank Schanda, (herein called defendant,) was indicted, tried and convicted in the circuit ’ court of Will county for the murder of William Schmook. After his motions for new trial and in arrest of judgment had been overruled he was sentenced to imprisonment in the penitentiary for a term of ninety-nine years, the penalty fixed by the verdict of the jury. Pie has sued out a writ of error from this court for a review of the record.
