This is an action for damages for personal injuries. Plaintiff had a verdict for $10,000. Defendant seeks review of the judgment therein, on writ of error.

Defendant's assignment is that its peremptory instruction, in the nature of a demurrer to the evidence at the close of the case, should have been given. Plaintiff was employed by the WPA (Works Progress Administration, an agency of the United States) on a project to straighten, deepen and widen the Blue River in Kansas City, and to beautify its banks.
