This is an appeal from a decree of the circuit court of Shelby county for the reformation of a deed.

Ferdinand Garber died in 1868, intestate, leaving a widow, Emma Garber,.and his children, Henry, two years old, and Fred, then unborn, his heirs. He was the owner of one hundred acres'of land, eighty acres having on it a small house in which he lived with his family, and twenty acres of timber land two miles, south-east.
