LAKE, Justice.

Virgil Lee Rose (“Rose”), an employee of Isenhour Brick & Tile Company (“defendant”), was killed while he was operating a brick-setting machine designated “machine number three” in defendant’s brick manufacturing plant. Rose’s wife, plaintiff Lisa Leonard Rose (“plaintiff’), individually and as the administratrix of Rose’s estate, filed suit against defendant on 24 September 1991 seeking to recover compensatory and punitive damages for Rose’s on-the-job death.
