Appellee filed a bill in the circuit court of St. Clair county to the September term, 1910, seeking a mandatory injunction to compel appellant to remove a certain dam constructed by him in a ditch on his premises, and to fill up another ditch, in order that the water then flowing through the last named ditch onto appellee’s land might be carried through an old drain or channel which appellant had dammed up.
