PERRY, Judge:

The appellant was convicted by a special court-martial, consisting of a military judge alone, of the offenses of assault and battery and of striking a superior noncommissioned officer while in the execution of his office, in violation of Articles 91 and 128, Uniform Code of Military Justice, 10 U.S.C. §§ 891 and 928, respectively. He was sentenced to a bad-conduct discharge, forfeiture of $200 per month for 5 months, imprisonment for 5 months and reduction to the lowest enlisted grade.
