Defendant in error, plaintiff below, brought suit against plaintiff in error upon a promissory note to recover $5,000 and interest. The parties will be referred to here as in the trial court. The complaint alleged that the Champion Oil Shale and Refining Company, hereinafter designated as the Champion Company executed and delivered its promissory note, bearing date July 3, 1920, for the sum of $5,000, to J.
