Numerous errors are assigned, but we deem it necessary to notice only those which challenge the action of the court below in finding- and adjudging that there was any individual or personal contract between these appellants or between Dodge, Boyle, *374McNair and Rising and the appellees, or their assignors, for the carrying on of said mining operations; and in finding and adjudging that there was any partnership between the appellants as between themselves or any other persons for the carrying on of the mining operations upon the property, and in finding that in December, 1900, and January,…
