(After stating the foregoing facts.) This case involves the proper construction of the act of 1924 (Ga. L. 1924, p. 195), which has not heretofore been before this court. The exact question in the case at bar is whether, when the date for the execution of one convicted of a capital offense has passed by reason of the grant of a reprieve by the Governor, the date of the final enforcement of the sentence shall be fixed by the court in which the accused was tried and convicted or by the executive order issued by the Governor.
