—Appeal and cross appeal from certain parts of an order of Supreme Court, Erie County (Gorski, J.), entered June 25, 2001, that, inter alia, denied that part of plaintiff’s motion seeking to hold defendant in contempt.
It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law and in the exercise of discretion by deleting the words “after income tax impact” from the fourth ordering paragraph and by granting that part of plaintiff’s motion seeking an award of counsel fees and as modified the order is affirmed without costs and the matter is…
