VANASKIE, Chief Judge.

The basis for this conspiracy to commit mail fraud and mail fraud prosecution is the alleged willful under-reporting to governmental agencies of municipal waste received by Empire Sanitary Landfill, Inc. (“Empire”) over a period of about seven years. The indictment charges that defendants Renato P. Mariani (Empire’s President), Michael L. Serafini (Empire’s Assistant Secretary), Leo R.
