This is an undefended appeal.
Appellee sued appellant in an action on the case for personal injury, laying her ad damnum at $20,000. On December 10, 1903, her declaration was filed, to which appellant on December 22, 1903, filed a plea of the general issue. On May 2, 1906, an order was entered dismissing appellee’s suit for want of prosecution and a judgment for costs entered against her.
On motion of appellee the Circuit Court on April 4, 1907, vacated the order of dismissal and judgment for costs and reinstated the cause upon the docket. Appellant entered its motion for a new trial, which was…
