I. UNDISPUTED FACTS AND PROCEDURAL HISTORY

On June 19, 2004, the debtor, Anna Dis-pirito (the “Debtor”), executed a retail installment contract in connection with the purchase of a 2002 Ford Explorer. On February 6, 2007, the Debtor filed the within Chapter 13 proceeding and proposed Chapter 13 plan (“Plan”). In the Plan, the Debtor scheduled the claim of Ford Motor Credit Company (“Ford Credit”) at $12,000, expressed the intent to modify the claim pursuant to 11 U.S.C § 1322(b)(2) and to pay the sum of $9,800, without interest,…
