In the case of Thos. P. Smith, Secretary of State, et al., Plaintiffs in Error, v. State ex rel. Hepburn, Defendant in Error, infra, 113 Pac. 932, I based my concurrence in the conclusion reached by the court upon the ground that upon the acceptance of the terms and conditions of the Enabling Act by the Constitutional Convention by ordinance irrevocable, that part thereof which provides that, “the capital of said state shall temporarily be at the city of Guthrie, in the present territory of Oklahoma, and shall not be changed therefrom previous to Anno 'Domini nineteen hundred and thirteen,…
