*844In an action, inter alia, to recover damages for breach of contract, the plaintiffs appeal, as limited by their brief, from so much of an order and judgment (one paper) of the Supreme Court, Westchester County (Scheinkman, J.), entered October 15, 2008, as granted that branch of the defendant’s motion which was to dismiss the amended complaint as time-barred pursuant to CPLR 3211 (a) (5), and dismissed the amended complaint.
