This matter is before the court on plaintiff Brian Korn’s (“plaintiff’ or “Korn”) motion to remand the instant action to the Superior Court of California for the County of Solano on the grounds that defendant has not established that (1) it is not a citizen of California; (2) the putative class members’ claims exceed the requisite jurisdictional amount in controversy of $5,000,000 pursuant to the Class Action Fairness Act of 2005 (the “CAFA”), 28 U.S.C. § 1332(d); and (3) the exceptions to CAFA do not apply.
