Mason,' J. :

William Sehaben and Clyde Wood appeal from a conviction upon a charge of grand larceny. The facts necessary for an understanding of the merits of the contention made will be stated in connection with the discussion of the several assignments of error.

The information contained three counts, the third of which was drawn under section 83 of the crimes act (Gen. Stat. 1901, §2076), which declares that any one altering the mark of an animal with intent to steal it shall be adjudged guilty of larceny. It *423charged in proper form the felonious…
