Frederick B. Kilgore and Robert L. Kilgore, brothers, were arrested on August 7,1962, within the District of North Dakota on a criminal complaint charging them with importing and bringing into the United States for the purpose of prostitution one Margaret Anne Smith, an alien. Both appellants were released on bond, Robert L. on August 21st and Frederick B. on August 30th. On September 7, 1962, an indictment was returned by a-grand jury charging the two appellants with the violation of 8 U.S.C.A. § 1328.
