Presently before the Court is the Thompson Hine Defendants’ motion for summary judgment based upon their argument that Plaintiffs Jones Act claims have abated as there is no statutory beneficiary. For the reasons that follow, the motion ■will be denied.
This case was transferred in April of 2011 from the United State District Court for the Northern District of Ohio to the United States District Court for the Eastern District of Pennsylvania, where it became part of the .consolidated asbestos products liability multidistrict litigation (MDL 875).
