An action was brought in the district court of Arapahoe county involving the ownership of a mine, and pending its determination, at the instance of plaintiffs, a receiver was appointed who took possession of, and worked it. After his appointment, and upon the application of defendants, plaintiffs Were required to give a cost bond upon which appellants here were sureties. By the final judgment and decree in that action, which was rendered May 25,1898, plaintiffs’ complaint was dismissed, and defendants recovered judgment against them for all costs of the action, including the costs incurred by…
