This matter is before this Court pursuant to an adversary proceeding commenced by the Official Committee of Unsecured Creditors of Interstate Cigar Co. (the “Committee,” or “Plaintiff’) seeking to recover certain accounts receivable from the Defendants, Sidney, Joel, and Gary Spielfogel (the “Defendants”). The Defendants have made a motion for summary judgment to dismiss the adversary proceeding on the grounds that the Plaintiffs’ action is time barred.
