This appeal arises from a qui tam action brought by Johnny Ray Long against GSD & M Idea City, LLC 1 for violations of the False Claims Act (FCA). 2 At the time Long filed his FCA claims, he was the debtor in a confirmed Chapter 13 bankruptcy plan and he failed to disclose his FCA claims to the bankruptcy court. After discovering his failure to disclose, the district court dismissed Long’s FCA claims under the doctrine of judicial estoppel. Long appealed, arguing that judicial estoppel should not apply because he had no motive to conceal his FCA claims…
