Appeal from a judgment of the Appellate Division of the Supreme Court in the first judicial department, entered May 15, 1917, affirming a judgment entered upon the report of a referee in an action for an accounting. Under the trust agreement in suit the trustee is directed to apply the income arising from a certain part of the trust estate to the use of George A. Fuller, an infant! The Nassau County Trust Company had been appointed general guardian of said infant.
