O’NIELL, Chief Justice.
This is a suit for disability payments and for a return of premiums paid under a policy of life and disability insurance. The company pleaded in defense of the suit that the plaintiff wasc, not wholly disabled, and was not presumably permanently or continuously prevented from engaging in any occupation whatsoever for remuneration or profit. The company pleaded also in its answer to the suit that it did not receive “due proof” of any such disability before the suit was filed.
