MEMORANDUM AND ORDER ISSUING PRETRIAL RULING

JOHN W. OLIVER, Senior District Judge.

This condemnation case pends on plaintiff’s September 22, 1982 motion for a pretrial ruling as to whether defendants have acquired legal access over a haul road on the land abutting the parent tract. Pursuant to this Court’s Orders of October 6,1982 and November 12, 1982, the parties have conferred and drafted a stipulation of all undisputed facts.
