MEMORANDUM OPINION

ORMA R. SMITH, District Judge.

This is an action by plaintiff 1 to recover compensation for certain channel improvement work performed by plain tiff for defendant. 2 The ease was tried to the Court without a jury and is now for disposition on briefs.

The Owner is a drainage district created and operating under and by virtue of the laws of the State of Mississippi. 3
