Spain, J. Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered July 15, 1992, upon a verdict convicting defendant of the crimes of robbery in the first degree and murder in the second degree (two counts).
In the early evening hours of July 9, 1990, defendant met with Chao McBride and Anthony Washington at Mary Fen-dick’s apartment. The trio planned to call a cab and then rob the driver.
