DAWKINS, District Judge.

Plaintiff, a copartnership whose members are residents and citizens .of states other than Florida, brought this suit to recover of defendant, a citizen of the latter state, the sum of $35,-000 as damages alleged to have been suffered by the breach of a contract to accept delivery of some 533 barrels of fine granulated sugar, being the remainder of a total of 600 barrels sold under three separate contracts. The contracts all bear the same date, and were for 200, 300 and 100 barrels, respectively, and, as their terms are otherwise identical, we quote the first, as…
