Sections 401 and 402 of the Labor-Management Reporting and Disclosure Act of 1959 (“LMRDA”), 29 U.S.C. §§ 481, 482, regulate union elections and authorize the Secretary of Labor to bring suit to enforce these provisions. Before the Secretary can commence an enforcement action, a member of the union must exhaust — or attempt to exhaust — his internal union remedies, then file an administrative complaint with the Secretary.
