The application was based upon the affidavit of the secretary of the company stating, that “ it, the defendant, believes,” &c., setting out the matters required in affidavits for such removals by the Act of Congress of March 2, 1867. This action having been commenced in the District Court of Pillmcire county, the defendant applied, under Chap. 196 of the laws passed at the second session of the 89th Congress, (14 Statutes at large, 559) for its removal into the Circuit Court of the U.
