OPINION OF THE COURT
Sullivan, J.
In this action to set aside, on the basis of fraud and overreaching, the parties’ agreement in settlement of the husband’s divorce action, the husband appeals from the denial of his motion to dismiss the complaint for failure to state a cause of action.
The facts are relatively straightforward. The parties were married in May 1998 and divorced in 2004. At the time of the marriage, plaintiff wife was 22 years of age and had just graduated from college. Defendant husband was 27, with an MBA from Columbia University.
