MEMORANDUM OPINION
MICHAEL, District Judge.
The instant action is presently before the court on defendant’s motion to dismiss the plaintiff’s suggestion of garnishment and the writ of execution issued by this court on April 15, 1981. Evidence was taken and oral argument heard on defendant’s motion on both May 26, 1981, and October 13, 1981. Jurisdiction is conferred upon this court by the fact that plaintiff is attempting to enforce a consent judgment entered in its favor, and against the defendant, by the United States District Court of the Eastern District of Missouri.
