This action was commenced in the district court for Rice county, the plaintiff alleging, that on the 13th day of duly, 1867, the defendants (J. M. Toiler and David Barker) assaulted him, and imprisoned him in a hotel, occupied by one of the defendants, for the period of five days, and put him in irons, and kept him chained during said period, by means whereof the plaintiff was greatly injured, &c.

This is an action for false imprisonment.
