This action arises out of the termination of the disability retirement benefits of plaintiff Richard Mathews. This matter is before the Court, with the consent of the parties pursuant to 28 U.S.C. § 636(c), for consideration of two motions. Plaintiff1 filed a motion for judgment on the pleadings on February 27, 2014. Motion for Judgment on the Pleadings (“Plaintiffs Motion”), ECF 26.
