THIEME, Judge.
The State appeals the decision of the Circuit Court for Prince George’s County granting the petition of Hosea Eugene Purvey for post-conviction relief. A jury convicted Purvey of first-degree murder on July 17, 1990, and he was sentenced by the court to life in prison on September 27,1990. Purvey appealed his conviction to this court on October 29, 1990, and we dismissed the appeal on January 30, 1991.
