William Cleary commenced his action for damages against the mayor and aldermen of the city of Savannah, on the 27th day of January, 1874 — the amount claimed being $10,000.00. The suit was for damages sustained from the overflow of his lands and crops by the sewer waters of Bilbo canal, and of Perry street lane canal — two canals used by Savannah for the purpose of draining the city by *155means of sewers emptying into them.
