This appeal presents the question of whether a hospital patient’s personal-injury claim alleging negligent operation of a beverage cart by a food-service provider is a “health care liability claim” for the purposes of the Texas Medical Liability Act. The patient appeals from the trial court’s dismissal of his claims for failure to file an expert report in compliance with the TMLA. See Tex. Civ. Prac. & Rem. Code § 74.351.
