MEMORANDUM AND ORDER

TRAGER, District Judge.

Following a jury trial in New York Supreme Court, County of Queens, petitioner was convicted of a number of crimes arising out of the fatal shooting of one man and the wounding of two others on the boardwalk at Rockaway Beach in Queens. This petition involves only the two most serious crimes of which petitioner was convicted — murder in the second degree, so-called “depraved mind murder,” see N.Y. Penal Law § 125.25(2), and manslaughter in the first degree, a lesser included count of intentional murder. See N.Y. Penal Law § 125.20. Defendant was…
