These two appeals will be disposed of in one opinion as the same questions are raised in each. Two bills of indictment were returned against defendant on August 28, 1940. Indictment to No. 42, August Sessions, 1940, containing two counts, charged defendant in the first count with unlawfully operating a private nursing home, and in the second with unlawfully operating a private hospital.
