Johnette Cosby (“Ms. Cosby” or “Petitioner”) requested an administrative hearing to challenge a determination by the Allegany County Department of Social Services (“the Department” or “Respondent”) that she was responsible for “indicated child neglect,” a finding which would result in her placement into the Department’s central registry of child neglectors. Prior to the hearing, her son was adjudicated to be a Child in Need of Assistance (CINA) based on the same allegations of neglect presented in the administrative action.
