This suit was brought in the court below by the appellee (plaintiff), a Virginia corporation, against the Board of Valuation & Assessment in Kentucky, consisting of Robert L. Greene, Auditor, Sherman Goodpaster, Treasurer, and James P. Lewis, Secretary of State, to enjoin the board from certifying to the Auditor for collection the license tax provided by sections 4189a-4189d inclusive, Kentucky Statutes, which the board had determined was due the Commonwealth from the defendant under the provisions of those sections.
