JONES, Chief Justice.

Appellant, Ralph A. Beaton, instituted-this suit July 1, 1930, against the Continental Southland Savings & Loan Association, to recover damages for the breach of a contract of employment entered into on January 30, 1929. By an amended petition filed March 14, 1934, the Metropolitan Building & Loan Association was made a party defendant. The same cause of action was alleged as in the original petition, and the additional allegations that, at a special meeting of the shareholders of the original defendant, September 8, 1932, a *906plan for reorganization was adopted, whereby 75…
