This case comes before the court on cross-motions for summary judgment. The action is brought for back pay, plain*18tiff claiming that his rights under section 12 of the Veterans’ Preference Act of 1944, 58 Stat. 387, 390; 5 U. S. C. 861, were violated when he was not transferred at a time when there was a transfer of functions from one agency to another.

Plaintiff, a graduate of the United States Military Academy, served,on active duty during World War I, and is an honorably discharged veteran.
