Two actions were brought by the plaintiff against the defendant, in each of which judgment was given in favor of the plaintiff in the court below, after a consolidation of the cases for trial. From this judgment the defendant appeals.

In both cases the complaints set forth causes of action to quiet title to certain mining claims, nine in number, of which he claimed ownership. In its answers the defendant set up a claim of ownership to twelve mining claims which conflicted with or overlapped the ground claimed by the plaintiff.
